Subject: Advertising trailers parked in the Lay-by off the East kilbride Road on the left hand side after Viaduct Road.

Hi Gerry

Would appreciate if you can give some details of the advertising trailers parked in the Lay-by off the East kilbride Road on the left hand side (after Viaduct Road) going from Sheddens Roundabout to Busby.

They would appear to be breeding by the day.
Who approves these?
Are they licensed?
Should they be licensed?
Are there not too many of them now?
Is there a process for approving/monitoring these advertising trailers?

Your help will be appreciated.

..., they do not need a licence but they will generally require planning permission.

The trailers would be considered under the terms of Regulation 2 of the Town and Country Planning (Control of Advertisements) (Scotland) Regulations 1984 as a "device"..."employed wholly or partly for"..."or adapted for use, for the purpose of the display of advertisements".

ERC would process and determine any application made under the 1984 Regulations under delegated powers

Equally, if they are blocking a public road in any way they may be removed by police or the roads authority in terms of the roads legislation.

I'm not aware if the planning service is aware of these or has received applications for consents.

Would appreciate if you can pass my email and your response to your colleagues in planning service and ask them if they are aware of the number of trailers parked in the lay-by and the position regarding received applications for consent and ask them to get back to me with an update.

Further to previous correspondence on the above matter, I can confirm that an enforcement case has been opened and given reference 25/00015/ENF. I can see from the file that you would have been advised of this on 26th February. Apologies if you did not receive this email.

The Compliance Officer is currently investigating the matter and she will update you directly once she has completed her investigation. In the meantime, please be advised that enforcement cases can take some time to resolve but we will endeavour to update you as soon as we can.

I refer to your previous emails in respect of the above matter and I apologise for the delay and lack of response.

By way of explanation, the Development Compliance Officer is a shared role between Planning and Building Standards and cases have to be prioritised according to risk to public safety.

To update you, the Development Compliance Officer has carried out site visits;

identified the owners of the adverts; communicated with them that Advertisement Consent is required;

and advised that it is unlikely to be granted.  She has also given clear deadlines for removal:

however, frustratingly only 2 of the 11 owners have complied with this request. 

The Planning Service now intends to serve 9 separate Advertisement Enforcement Notices on the owners of the remaining adverts. 

In tandem, the Development Compliance Officer has been engaging with colleagues in the Council's Roads Service with a view to taking more direct action under the Road (Scotland) Act 1984.

Please be assured that while we have regrettably been slow to communicate with you, effort has been made to resolve your complaint. 

The work undertaken on this case so far has been time consuming. 

This is nevertheless necessary to ensure due process is followed. 

I am confident that this matter will be resolved satisfactorily, however as it is a complex process, involving other agencies,  I am unable to provide a definitive timescale on when this will be.

Either I, or the Development Compliance Officer, will be happy to update you further at any point.

Stage 2 Investigation GOSS 6682-8692-9905-9322

Thank you for your correspondence, which has been escalated to me at Stage 2 of our complaints procedure.

I have investigated the matter and can report the outcome of my investigation as follows;

The Development Compliance Officer is a shared role between Planning and Building Standards and cases have to be prioritised according to risk to public safety.

The priority applied is related to the level of risk to the public, and the resources available. 

Be assured that an investigation is taking place and a conclusion will be drawn.

This issue is complicated because of multiple advert owners.

The Development Compliance Officer has identified 11 different owners of the adverts and they have each received communications advising that:

- Advertisement Consent is required

- it is unlikely that Advertisement Consent will be granted, and

- clear deadlines for removal have been issued.

At the moment, 5 of the 11 owners have complied with this request. 

The Planning Service is considering what further action to take.

For example, it could serve 6 separate Advertisement Enforcement Notices on the owners of the remaining adverts. 

However, it may be expedient for the Council's Roads Service to take more direct action under the Road (Scotland) Act 1984 and the Development Compliance Officer is engaging with colleagues in the Roads Service.

We apologise that we have been slow to communicate with you, but wish to reassure you that effort has been made to resolve your complaint. 

As you were previously advised by Derek Scott on 27 June, the Planning Service is confident that this matter will be resolved satisfactorily, however as it is a complex process, involving other agencies,  we are unable to provide a definitive timescale.

We will endeavour to advise you on the final result when we have ensured that due process is followed.
