Excellent report and everything sounds super.

We have no concern with the report author who is required by his employer (ERC) to submit a report in a certain format.

However............................

Let us put the report in a different context.

The Freedom of Information (Scotland) Act, 2002 (FOISA) is explicate.

The only information required to be provided by a requester is their Name and a contact, email address and nothing to do with the purpose of the request.

Are these stats now produced because Leader Anthony Buchanan and Cllr Daniel Devlin made a request at the time of last years request, to be informed of the actual identity of who was applying for FOI's. ?

Even though the actual identity cannot be provided to them, as the identities are subject to Data Protection restrictions.

A small caveat has been placed against the numbers of individual requester s.

However is there any actual purpose to this figure.

Is the figure even, as claimed, indicative of the actual number of individual applications.

We are aware of a number of applicants who applied and did not state they were actively working with a group.

We are also aware that these applicants never declared where they lived or their location, whether inside of outside ER, Scotland or the UK.

Accurate data collection and reporting?

What this actually tells us is not how well the council staff have responded to its legislative obligation, it shows how much they have failed the public, and failed to comply with the FOISA legislation.

85% of applications were responded within the 20 working day time scale.

FOISA states that a public authority must comply promptly with a request for information and in any event not later than the 20th working day from receipt of the request.

The 20 working day commences the day after the request was received.

ie. Request received on Tuesday at 9am, the clock does not start running until 9am on Wednesday.

Therefore 276 applications were outwith the time scale set down by legislation.
