WE would wish to highlight that Councillor Hay does not represent the Ward covered by NMCC therefore he has no requirement to attend.

THE Scottish Government is planning a community empowerment bill which is intended to provide CC's more power and authority, due for publication in a 2015. ERC have launched a review of the Scheme for Establishment of Community Councils, running now for approximately 1 year.

This local review will look at constitutions and areas maps etc.

Why is ERC rushing into this review when the Scottish Government may alter the rules in 2015, if ERC are undertaking a review at present, why are they rushing to punish three CC's, unless they wish to clip their wings before any more time passes.

WE would have to suggest that council officers appear to be wilfully attempting to pull the wool over elected members eyes on this subject.

The Scottish Government issued a Model CC Constitution, intended as a National template on wish Scottish CC's could base themselves on, with local variations as required

I apologise for my mistake and as stated Councillor Hay would have no need to attend NMCC.

16. Alterations to the Constitution

Any proposal by the COMMUNITY COUNCIL to alter this Constitution must be first considered by a meeting of the COMMUNITY COUNCIL and the terms of the proposal to alter the Constitution shall be stated on the notice calling the meeting, which shall be issued not less than ten days prior to the meeting. Any proposed alterations may not prejudice the terms and objectives contained within the Scheme for the Establishment of Community Councils.

If the proposal is supported by two-thirds of the total voting membership of the COMMUNITY COUNCIL and is approved in writing by the local authority, the alteration shall be deemed to have been duly authorised and can then come into effect.

Therefore CC's can amend their constitutions, If the Council disagree with the alterations the legislation states that the decision must be referred to the Scottish Government.
